Pursuing Accountability for systemic pushbacks at the Poland/Belarus border under international law

The first part of the thesis will analyze whether Poland is in violation of their international human rights obligations and obligations under international refugee law and whether the situation at the border with Belarus give rises to state responsibility by constituting an internationally wrongful act. The second part will address the potentially shared responsibility of the European Union (EU) as an international organization (IO) for human rights violations. Going a step further the third part will examine if cases of systemic pushbacks fall under the legal definition of crimes against humanity pursuant to Article 7 of the Rome Statute and if Polish leadership and EU leadership is potentially individually criminally responsible before the International Criminal Court (ICC). In conclusion a reflection on the two regimes and their ability to bring justice and relief to migrants will follow.
