The Interface Between Contractual Liberty of Enterprises and Enforced Sharing on Essential Facilities

Abstract

dc:description

With this understanding, this dissertation focuses on the extent to which Korean use of the essential facility doctrine can benefit from knowing how other jurisdictions have thought about and applied the doctrine. In order to give Korea some normative guidelines on how it ought to think about using the doctrine, this dissertation surveys the economic theories of the doctrine and studies different viewpoints of the economic results from the application of the doctrine between the U.S. and the EU.
