Abstract
dc:description.abstractThe improvement of medically assisted reproduction technologies have raised many complex legal and ethical issues. The possibility to create embryos in a laboratory and to allow them to survive outside the womb questions well-known legal ideas. The author analyses the legal status of ex utero human embryo and compares it to that of in utero fetus, considering all necessary distinctions given its peculiar situation. After showing that the current legal framework is inapropriate in the case of ex utero embryo, the author studies different theories on the subject and recognizes the need for a new legal category and particular legislation both in civil and criminal law.
