The mediation is an alternative dispute resolution (ADR) practice. It is based on age-old ideas and has been used, more or less formally, in traditions which foster harmony and the maintenance of social cohesion. It permits the parties involved to negotiate in presence of a third party. In the current context of questioning of the legal norm and the traditional legal system, and the development of legal pluralism, mediation raises important issues related to transformation of the law. In this situation, the transformative mediation approach can play a distinctive role. It brings conflicting parties into a process that fosters the development of new skills, empowerment and recognition of the other and has a potential multiplying effect for the rest of the society.
