La violencia de género en el sistema penal. Aproximación desde una perspectiva victimológica en la Comunidad Autónoma de La Rioja

The relevance of the digital asset and the remarkable increase in its use in recent years reframe the social dimension of gender-based violence as a complex problem. In order to analyze this reframe, it is necessary to define its concept. From its social and psychological implications, this paper is particularly interested in the resulting criminal law effects. Therefore, we propose a concept of digital gender-based violence based on behaviors that are offensive to women in the digital scope and worthy of condemnation. Based on this theoretical framework, we seek to understand the situation through both jurisprudential studies and, above all, a contextual context based on information derived from observations of victims of gender-based violence conducted by the La Rioja Office for Victims of Crime Assistance. This approach allows us to draw conclusions and propose recommendations related to the criminal law response necessary to contain this growing problem.
