This thesis attempts to identify and analyze the issues involved in determining the constitutionality of compulsory Communist Party registration vis-a-vis the First Amendment. This constitutional question came before the United States Supreme Court in the Communist Party case, 367 US 1 (1961). An analysis of the provisions of the Internal Security Act of 1950 provides the groundwork necessary for a discussion of the arguments presented on the First Amendment issue in the briefs filed in the Communist Party case. An analysis of these arguments uncovered the points of agreement and disagreement on five key issues involving the First Amendment question. Analysis of these issues allows several conclusions as to the validity of the arguments, the nature of the judicial process in which they were arbitrated, and the location of areas in which further research would yield valuable information.
