This constitutional question came before the United States Supreme Court in the Communist Party case, 367 US 1 (1961). An analysis of the provisions of the Internal Security Act of 1950 provides the groundwork necessary for a discussion of the arguments presented on the First Amendment issue in the briefs filed in the Communist Party case. An analysis of these arguments uncovered the points of agreement and disagreement on five key issues involving the First Amendment question.
