Beitrag zur Beurteilung von technischen Maßnahmen bei der Vorsorge gegen Umweltbeeinträchtigungen am Beispiel des Einsatzes mineralischer Materialien zur Verfüllung von Abgrabungen

dc:descriptionAfter closing any open-pit raw material mine, the issue of the future use of the present excavation arises. As a rule, the resulting mass deficit is backfilled with insignificantly contaminated soil material or building rubble accumulating in building projects in considerable amounts. For the plugging with these typical mineral wastes to be carried out without damage and in proper form, the Federal States were recommend the use of the Technical Rule M20. A considerable change of the legal situation in exploitations was caused by the introduction of a standard national soil law in 1999. Special confusion was triggered by the new precaution values contained in the new German federal legislation on soil protection and contaminated soils (BBodSchV). The attempt made in the following years to adapt the rules to the stricter soil and water-law specifications was not very successful. The federal states reacted with differing regulations on the arising vague legal situation in assessing the exploitation of mineral wastes. In assessing the environment-related quality of an exploitation the material specific amount of harmful material is the most important and in most cases the decisive criterion. In order to ascertain the overall value and the substance portion that can be mobilised the methods of solid matter and eluate analyses are used. Still, the significance of elution methods is problematic in the way that the presence of numerous error sources exacerbates the transfer to real conditions. The subject of this thesis is, as a first step, to compile the criteria apt to improve the environment-related quality of a backfilling. The substantial composition of materials and the possibility to influence them in a way that positive qualities are not lost is examined. In this thesis, the criteria are related to each other in a newly developed decision matrix. Using a example the practical usability of the decision matrix is simulated. Starting from the outline data of an imaginary excavation all elements of the plugging are named. The decision matrix with its various conceptual approaches helps the operator as a working aid during a backfilling to act responsibly regarding both the structural engineering and environment-related responsibilities. It is to enable the responsible licensing authority to gain a safe control and insight into a backfilling operation under different aspects. Due to the high transparency of the backfilling operation it should become possible to retrace all actions and to apply the existing legislation in full instead of only deciding only in with respect to the adherence of threshold values. Through the obligatory and integrated concepts of “seepage water forecast” and “ground water monitoring” the possible toxic material accumulation is to be prevented. Other concepts do not answer the direct main purpose of toxic material checks, but in all of them it is a partial aspect of the decision matrix. All in all, the application of all presented concepts is to lead to an environment aware backfilling thus allowing a responsible dealing with the environment media soil and water.
