Abstract
dc:description.abstractThe right to privacy, fondamental right recognized by section 5 of the Charter of human rights and freedoms, is part of the new Healt Act. However, section 433 of this new law is a major exception to that fondamental right. Section 433 enables the minister to obtain nominative informations directly from the Healt centers. This important breach to the right to privacy is analyzed in view of the democratical principles developed by authors and jurisprudence in regards of the Charter. Done in a context of administrative efficency, the right to privacy finds here an application that evoques a tendency of the governments to introduce themself in the private life of their citizens.
