Criminal Liability for Illegal Possession of Narcotic Drugs or Psychotropic Substances This thesis analyzes the criminal for unlawful possession of narcotic or psychotropic substances. In the first chapter, the author analyzes the criminal for unlawful possession of narcotic and psychotropic substances the historical development. Also, thesis analyzes the international legal framework related to drug control and drugs control policies in various European countries. The author thus recommends the elimination of use related activities from the Criminal Code as they can’t be considered serious offences. In the second chapter, the author analyzes the peculiarities of the Lithuania legal regime. In Lithuania criminal law, a significant districtions is made between dealers and users. The type of prosecution depends on the amount of drug involved, if there is no other evidence of intent to sell. Also, the author analyzes the distribution of narcotic or psychotropic substances among minors. The third chapter analyzes types of penalties for unlawful possession of narcotic or psychotropic substances and imposition of a more lenient penalty than provided for by a law. Also, the thesis analyzes release from the criminal liability and suspension of a sentence and release form a penalty.
