Abstract
dc:descriptionProbation is a conditional alternative to a custodial sentence (deferred sentence and the release on parole from correctional institutions), during which the probationer is supervised. Its aim is to ensure that the probationer has an effective resocialization and to reduce re-offending. If the person fails to comply with the obligations imposed on probationers, the court, on the recommendation of the probation service, may lift the suspension of the sentence and send the person for execution of the sentence imposed. The main aim of this paper is to review the results of the practice of the Vilnius District Court and to show both the motives of probation officers when submitting motions for lifting probation and the court's motives for deciding on the lifting of the suspension of sentence. The study revealed that probation officers most often refer to the court applications concerning breaches of probation conditions and administrative offences committed by probationers. Judges' decisions to terminate probation are usually motivated by the fact that there is no possibility of proving a change in behaviour and that the purposes of the sentence are not being met and that further probation is not effective. In the case of non-compliance, the reasoning is usually that the probationer is largely fulfilling the obligations imposed in a satisfactory manner, that there have been no violations, or that there have been a few violations, but they are not particularly serious or serious and do not lead to the possibility of lifting probation.
