Alcances de la prohibición de regreso en delitos de colusión apropósito del caso Monroy Gálvez

Abstract

El presente trabajo tiene como finalidad explicar los alcances de la institución de la Teoría de la Imputación Objetiva como es la denominada Prohibición de Regreso, principio que excluye de responsabilidad penal de quien actúa sin generar un riesgo propio relevante. Esta institución lo aplicaremos en uno de los ilícitos penales más frecuentes en nuestro país como es el delito de Colusión Agravada, figura que sanciona todo aquel acuerdo ilícito entre un funcionario público y un tercero para defraudar al Estado, constituyendo una forma de corrupción que afecta la integridad de las instituciones públicas. Ambos conceptos se analizan desde el derecho penal sustantivo, rama que determina qué conductas son ilícitas y en qué condiciones se imputa responsabilidad, buscando así, definir cuando una conducta debe ser penalmente sancionada y cuando no. El objetivo principal es definir y delimitar el alcance de dicha institución cuando se presenta en contextos vinculados a actos colusorios. Para ello, se empleará bibliografía especializada, destacando los aportes teóricos de Claus Roxin y en especial de Gunter Jakobs, cuya información resulta fundamental para comprender la teoría de la imputación objetiva, que sostiene que para imputar responsabilidad penal, es necesario no solo examinar la relación causal entre la conducta y el resultado, sino también el riesgo jurídicamente relevante que la acción del autor ha generado, es decir, si su intervención ha incrementado un peligro significativo para el bien jurídico protegido. Asimismo, el análisis estará respaldado por jurisprudencia relevante, la cual permitirá contextualizar y aplicar los conceptos teóricos a casos concretos. Finalmente, como conclusión se observó que la Casación N° 526-2022, desde la teoría de la imputación objetiva, no se le puede atribuir responsabilidad penal cuando la conducta se enmarca desde un acto neutral, coincidiendo con los Magistrados en el punto de que el abogado actuó dentro de su rol profesional, sin tener ningún vínculo ni conocimiento del hecho delictivo, garantizando de esa forma el principio de legalidad.This study aims to explain the scope of the institution of the Theory of Objective Imputation, specifically the principle known as the "Prohibition of Return", which excludes criminal liability for individuals whose actions do not create a legally relevant risk. This legal doctrine will be applied to one of the most frequent criminal offenses in Peru: the crime of Aggravated Collusion. This offense penalizes illicit agreements between public officials and third parties to defraud the State, constituting a form of corruption that undermines the integrity of public institutions. Both concepts are analyzed from the perspective of substantive criminal law, which determines what conduct constitutes a crime and under what conditions criminal liability is attributed, with the aim of defining when a certain act should be subject to penal sanction and when it should not. The main objective is to define and delimit the scope of this legal principle when applied to contexts involving collusive acts. To achieve this, specialized literature will be consulted, emphasizing the theoretical contributions of Claus Roxin and, in particular, Günther Jakobs. Their work is essential for understanding the Theory of Objective Imputation, which holds that attributing criminal responsibility requires not only an analysis of the causal link between the conduct and the result, but also an assessment of whether the defendant’s action created a legally relevant risk—i.e., whether it significantly increased the danger to the protected legal interest. Furthermore, the analysis will be supported by relevant case law, which will help contextualize and apply theoretical concepts to specific cases. Finally, as a conclusion, it was observed that Cassation No. 526-2022, based on the theory of objective imputation, establishes that criminal liability cannot be attributed when the conduct falls within the scope of a neutral act. This aligns with the position of the Justices, who affirmed that the lawyer acted within the limits of his professional role, without any connection to or knowledge of the criminal act, thereby upholding the principle of legality.
