Home State Options to Control the Human Rights Records of TNCs Acting Abroad
Abstract
This dissertation, written in English, examines the options of home state to control the human rights records abroad, as far as their own TNCs abroad are concerned. In doing so, different possible ways to control TNCs and guest states are analyzed. On the one hand legal options of domestic and international courts and (extraterritorial) domestic legislation as well as changes in public international law are examined. Examples are taken from different legal orders, for example the case law on the US American Alien Tort Claims Act (ATCA). On the other hand, political options, containing positive as well as negative sanctions and also trade restrictions are focused on. Concerning trade restrictions, their compatibility with WTO law is the main issue of the enquiry. By covering these very different options, the dissertation shows that there are manifold ways to solve human rights issues. Furthermore, by dealing with the different possible measures in the limited and confined situation of home state TNCs acting abroad, the work also illustrates that most challenges usually faced when applying extraterritorial measures or measures with extraterritorial effect can be overcome.
