Il lavoro penitenziario tra rapporto contrattuale e mercato del lavoro. Lezioni comparate dai casi francese e spagnolo.
Abstract
dc:descriptionThis thesis deals with the subject of prison labour in Italy. It is a very complex subject that is deeply affected by the structural and organisational critical issues of prison labour in Italy. Work in prison is functional to the re-education of the convicted person (Article 27 paragraph 3 of the Constitution). Nevertheless, the data on working prisoners show that the effectiveness of work, as a tool of social reintegration, is poor. The research framework followed in this thesis consists of two elements. Their identification allows the analysis of the '' grey zones'' that are produced by the theme of prison labour relationship, because of the discrepancy between the text of the law and the reality of the facts. The thesis consists of an introduction on the historical, social and legal facts of prison labour, and three chapters. The first chapter focuses on the French and Spanish lessons that Italy can learn to improve its prison labour model. The second one deals with a detailed survey of the individual employment relationship of prison workers. The third chapter, finally, considers the opportunity of drafting social and prison policies that can reinforce the dialogue between the prison and the labour market in the free society.
