Survol de la responsabilité de l'infirmière praticienne au Québec et en Ontario

Nurse practitioners are recognized for their expertise in a specifie area of healthcare. They act as professional nurses that perform tasks belonging to both the nursing and the medical fields. In response to the changing health needs of the population, the Quebec legislator expanded the traditional role of nurses by allowing nurse practitioners to prescribe and use diagnostic and therapeutic means that were previously reserved for physicians. The proposed Bill no 90 modifies nursing activities thus affecting nurse practitioners' liability towards patients. This essay attempts to examine how this new legislation will affect nurse practitioners' functions and their duties towards patients. Nurse practitioners in Ontario are considered as independent professionals since 1998. Because the law is not yet in effect and because there are so few nurse practitioners practicing in Quebec, the Quebec regulations were compared to the Ontario legal context. After analysing the legislation and the different cases in health law, it became clear that the nurse practitioner from Ontario has a more autonomous practice than the one working in the province of Quebec. Despite the increase in her responsibilities, the Quebec nurse practitioner remains the subordinate of the physician and the hospital.
