La gestion des plaintes des usagers des services de santé : réflexion sur la transposition du droit québécois au droit Néo-Brunswickois
Abstract
dc:description.abstractThis study tackles the question of managing user complaints in New Brunswick and Quebec health services. Our objective is to look into the possibility of transferring the Quebec model of complaint management to the New Brunswick health system. The presence of a different justice system in each of these two provinces has to be taken in consideration in the eventuality of a transfer, because of a possible barrier between the two families of law. In this context, we are focusing on a qualitative data analysis through documentary observation in administrative law. A retrospect examination of the past ten years on the legislative, jurisprudential and doctrinal levels is identified as our primary source of documentation. We are outlining the structure of the two health systems, and the development and protection of the user rights . We are then identifying the flaws of the protection mechanisms in each province, and are showing that taking user rights seriously means giving them some rights against the State. Lastly, we establish the necessity of a continuing transformation of these two systems.
