El estado mínimo de Friedrich August von Hayek y el combate a la corrupción del estado democrático brasileño. (Una propuesta para hacer retroceder a las fronteras del estado brasileño)
Abstract
[EN] The base theory of the present thesis has its origins in the liberal political philosophy of the Austrian economist Friedrich August Von Hayek, centered in the Minimal State, which would be exclusively dedicated to the classical functions on the Modern Democratic State: health, education, security and infrastructure, leaving other activities to the private sector. The basis of freedom as a moral principle and the principles of justice and peace, in the liberal political-economic environment of non-interventionism by the State in the Economy, are prerequisites. The Brazilian Federal Constitution of 1988 is analyzed, in this paper, in light of the Hayekian ideology. The thesis also presents the human nature of public corruption in the political and economic facets of the Democratic Rule-of-Law State, the semantic and cultural aspects of this social pathology characterized as a systemic corruption and, as a consequence, the crimes against the Public Administration proscribed by law. In light of the aforementioned topics, a proposal is developed with 13 (thirteen) pragmatic suggestions to push back the political and economic frontiers of the Brazilian State, saving public resources for a more efficient allocation in the social areas prioritized by taxpayers, and, consequently, mitigating corruption by the reduction of economic opportunities, by taking the State out of its large investor position.
