Abstract
[EN] The intention of this paper is to provide a historical overview, theory and practice of trust in the private and public area and put the emphasis on the analysis of the latter. Divide the task into two large spaces. Be described in a school in the private sphere, as has been said, and the other in the public domain. In the first part of this work has been used descriptive legal research technique respecting the historical sequence with a focus on differentiating the relevant elements and evolution of the different legal regimes detailed. In the second part of the research methodology has been realistic from the analysis of current legislation in various jurisdictions and their implementation, as well as the existence of the figure public trust in fact, without any law that expressly authorizes or delimit the basis of their legal status or their application.
