The dissertation aims at understanding how stereotyping is related to discrimination - both at a social and legal level -, to judicial reasoning and to the construction of models of female victims and female offenders. In this sense, the objectives pursued by the investigation were the following: 1) to identify the relevant elements of the notion of ‘stereotype’; 2) to recognise the operability of this notion in the legal sphere and, in particular, in judicial reasoning; 3) to identify the ways in which a stereotype can be present in judicial reasoning; 4) to verify the existence of profiles of women victims and perpetrators that influence judicial decision-making. The study, research and writing of this work have necessarily been guided by the adoption of a critical approach, from the perspective of deconstruction and reconstruction that is typical of the Critical Legal Theories. Specifically, the gender perspective has been adopted as a methodology that allows to unmask the automatisms that operate in cognitive and decision-making processes, deconstructing a social and legal reality strongly influenced by the assignment, among others, of gender roles. Furthermore, this research adopted the methodology of the social and legal sciences. Firstly, the research started with a a review of the available literature on the subject. Secondly, a jurisprudential investigation has been carried out, followed by the analysis of the judicial decisions. In terms of the structure of the work, the first chapter examined the relationship between cognitive processes, group dynamics and discriminatory practices, drawing upon insights from the psychological literature. In the second chapter, the necessity of counteracting judicial stereotyping was emphasised and some methodological proposals for counteracting judicial stereotyping were analysed. In the third chapter, an examination was conducted of the ways in which stereotypes may manifest in norms, facts and scientific knowledge within the context of judicial reasoning. This was achieved through a review of case law from a range of national and international judicial bodies. Finally, the fourth chapter presented three profiles of women representative of both ‘victim’ and ‘perpetrator’ status. In particular, the profiles of three women were examined: the woman who has been the victim of sexual violence, the woman who has killed her abusive husband and the woman who has killed her child. El camino de investigación emprendido en esta tesis se propuso comprender cómo el estereotipo se relaciona con la discriminación – tanto a nivel social como jurídico –, con el razonamiento judicial y con la construcción de modelos de mujer víctima y de mujer delincuente. En este sentido, los objetivos perseguidos fueron los siguientes: 1) identificar los elementos relevantes de la noción de “estereotipo”; 2) reconocer la operatividad de esta noción en el ámbito jurídico y, en particular, en el razonamiento judicial; 3) identificar las formas en que un estereotipo puede estar presente en el razonamiento judicial; 4) verificar la existencia de perfiles de mujeres víctimas y autoras de delitos que influyen en la toma de decisiones judiciales. A la luz de estos objetivos, el estudio, la investigación y la redacción de este trabajo han estado necesariamente guiados por la adopción de un enfoque crítico, desde la perspectiva de deconstrucción y reconstrucción propia de las Teorías Críticas del Derecho. En concreto, se ha adoptado la perspectiva de género como metodología que permite desenmascarar los automatismos que operan en los procesos cognitivos y de toma de decisiones, deconstruyendo una realidad social y jurídica fuertemente influenciada por la asignación, entre otros, de roles de género. Además, en esta investigación se adoptó la metodología propia de las ciencias sociales y jurídicas. Inicialmente, se realizó una revisión de la bibliografía disponible sobre el tema objeto de estudio. En un segundo momento, se llevó a cabo la investigación y el análisis jurisprudencial. Con respecto a la estructura del trabajo, en el primer capítulo, se ha observado la relación entre los procesos cognitivos, la relación entre grupos y la discriminación a partir de la literatura psicológica. En el segundo capítulo, se destacó la obligatoriedad de contrarrestar la estereotipación judicial y se analizaron algunas propuestas metodológicas de contraste a la estereotipación judicial. En el tercer capítulo, se ofreció una imagen diversificada de cómo los estereotipos pueden estar presentes en las normas, los hechos y los conocimientos científicos en el razonamiento judicial, a través de la referencia a jurisprudencia de diferentes órganos nacionales e internacionales. Por último, en el cuarto capítulo se examinaron tres perfiles de mujeres representativos tanto de la condición de “víctima” como de la de “autora” de un delito.
