An examination of the legal instruments involved in the transportation of humanitarian aid

This paper is broken into several logical segments. A brief introduction gives the New Zealand perspective of the administrative law side of aid decisions which is then followed by case study one on the transportation of aid to our South Pacific neighbours after a natural disaster. That material came from several indepth interviews conducted by my research assistant. The paper then moves on to the second case study of how New Zealand organised the transportation of aid to Tigray during a conflict situation. The third case study analyses a mutlilateral effort in Somalia to deliver aid . The three case studies all illustrate different legal and logistical problems that can be faced when transporting humanitarian aid. The case studies also highlight the different requirements between bilateral and multilateral aid efforts. They further give insight into the separate requirements if the aid is required as a result of a conflict situation or a disaster situation. The paper then moves on to carefully analyse all the legal instruments involved in the transportation of humanitarian aid and provides a conclusion based on the development of a global legal instrument to assist the delivery of aid in times of peace.
