La percepción de los ciudadanos respecto a la actuación del Consejo Nacional de la Magistratura, en los procesos de selección, nombramiento y ratificación de magistrados

The present investigation is carried out with the purpose of determining why the citizenship has a negative vision regarding the performance of the National Council of the Magistracy, being this a transcendental institution in the justice system, since its main function is to carry out the processes of selection, appointment and ratification of magistrates. I consider it necessary to transform the current perception of citizens in a positive way, with the aim that the citizenship values the Peruvian justice system, for this it is necessary to study it, know its functions, and know the causes that originate the current negative perception on the part of the population to the CNM, because, by recognizing them, we can identify how to eradicate them, and finally, obtain a positive view of the citizenship regarding the performance of the National Council of the Magistracy, in the processes of selection, appointment and ratification of magistrates. This thesis will serve as a research background for all citizens, who will know the conformation and functions of the National Council of the Magistracy; that is, to all the Peruvian people who seek justice, and wishes that the First and / or Second Instance Judge may grant it, and be certain that this magistrate is acting with independence, impartiality and probity. The problem posed is: How to obtain a positive perception of the citizenship, regarding the performance of the National Council of the Magistracy, in the processes of selection, appointment and ratification of magistrates? The main objective set out in the present investigation is: Determine the form of how to obtain a positive perception on the part of citizens regarding the performance of the CNM, in the processes of selection, appointment and ratification of magistrates, in this sense the proposed hypothesis is : Yes, the magistrates elected by the CNM, now the National Board of Justice, in the processes of selection, appointment and ratification of magistrates, act with independence and impartiality, and if the CNM publishes the resolutions issued by its office; then the citizens, will have a positive perception about it. The present investigation will contribute in the formation of jurists, so that they know the faculties of this Constitutionally Autonomous Organism, in addition to enhance the perception that citizens have regarding the exercise of their functions, which is closely linked to the perception that citizens have regarding the administration of justice.
