The development of public access to environmental information: An attempt to overcome the problems associated with traditional enforcement methods

The need to improve and encourage a national's participation in the protection of the environment, by making information concerning the state of the environment freely available has recently had considerable importance attached to it on all levels of Government. Although an individuals right to know the state of the environment and those who are causing harm to it, is a moral right, it is only recently that such a right has become acknowledged in law. This paper is an attempt to discuss, at both European and National levels, the development of access to information legislation, from the difficulties associated with traditional enforcement methods through to the implementation of the legislation into British statute and how such legislation sits with other environmental protection measures.
