To this extent, the paper will discuss the integral relationship between human right and refugee law. It is suggested that the CRC has affected greater recognition of how fundamental human rights, protected within the CRC, have influenced the evolution of State interpretations of the Refugee Convention to enhance protection for children. It is not the aim of the discussion to evaluate different systems of human rights enforcement, but rather to focus on the impact of the CRC as it currently stands; examining whether the Convention has influenced protection for child refugees in specific scenarios. Central to the position of the paper is the submission that the CRC has the potential to effect an urgent change in the perception of child refugees.
