La patologia del provvedimento amministrativo: analisi e sviluppo dell’eccesso di potere

Nowadays, misuse of power is the most important flaw of administative measures. Its history allows to understand the reason. Born by French jurisprudence as a non-defined institution, it would be inplanted in Italian jurisditional system by administrative judgements. The interest in misuse of power let it enter in Italian law system. Jurisprudence, anyway, contribuited to design a variety of form of it. Also, today misuse of power is enhancing its importance, especially for its appearence in communication and information technologies’contents. Its development, in recent times, need to be focused. This research try to explain how and why misuse of power is changing, with analysis of relevant case law too.
