The strength or otherwise of the National judged to subsequent effects pronunciations of the European courts is currently one of the most interesting profiles in the wider context of relations between supranational jurisdiction and laws of the Member States. In the absence of Union legislation on the subject, the discipline of res judicata and its stability fall within the internal legal competence of Member States, under the principle of procedural autonomy of the latter and in accordance with the principles of equivalence and effectiveness.
