This paper aims to present the problematic situation of the Brazilian prison system and its challenges to achieve its resocializing paper, taking care to respect the application of Penal Execution Law (LEP) No. 7.210/84, which determines how they should be implemented and enforced penalties of deprivation of liberty and restriction of rights. We seek to know the nature of educational measures offered to prisoners, identifying the mechanisms of rehabilitation are carried out with Brazilian prison population, its applicability and actually contributes to the social reintegration of convicts process. We could notice that, in terms of legal support and ressocializadora intention, Penal Execution Law presents a construction that provides dignified and humane for the serving of sentences conditions, and establishes the goal of rehabilitation of convicts. But these goals become distant and impractical due to the growing overcrowding of the system and the maintenance of prisons while deposit persons.
