Os deslocados ambientais haitianos no Brasil em face da atual legislação brasileira para refugiados

The Haitians migration to Brazil is not a novelty, however it has been intensified in a notorious way after the natural catastrophe which hit Haiti in January 2010. Looking for best life conditions and to rebuild their lives, the Haitians faced several troubles when arrived in here which has been lasted until this year in 2015, by the socialization process, government bureaucracy or necessity to get jobs. The Brazilian government taking in consideration the Conventions and Declarations which this country is signatory, did not help these individuals for do not know which treatment should be used, due to the fact they were not refugees with the premise of persecution. Thus, adopted several measures which were, besides innovative, insufficients to support everyone who was in an irregular situation. This monograph, written by the qualitative method, intends to expose the situation of Haiti in the pre-earthquake, the catastrophe and beginning of the mass migratory flow. Proposes, still, explain what are the difficulties found by the Haitians in Brazil, their present conditions in the country, the types of migration and migrants, the reason why it was chosen to denominate the Haitians as environmental displaced people and the justification of these environmental displaced Haitians might not be considered refugees by the current Brazilian legislation. Lastly, clarifies as is done his protection in the international scenario and what was the treatment offered by the government agencies responsible for the refugee and migration questions, and the current discussions for a reformulation of the current Brazilian legislation.
