O compromisso constitucional de acesso à justiça: a assistência jurídica no estado da Bahia, à luz do artigo 98 do ato das disposições constitucionais transitórias

Bearing in mind the article 98 of the Transitional Constitutional Provisions Act, included by the Constitutional Amendment No. 80/2014, determines that, until June 2022, all jurisdictional units, federal and state, must have units of the Public Defender´s Oficce, this bibliographic, explanatory, descriptive and exploratory research, seeks to outline a panorama of the acess to justice in Brazil, in the light of the constitutional commandments, collating existing models of state legal assistance and portraying the transition process between judicare and salaried staff model. The essay also analyses the near future of the state institution in Bahia. The study concludes that the salaried personnel model provides a better cost-benefit ratio to the population, within the constitutional dictates, but that the process of expansion and internalization of the Public Defender's Office of the state of Bahia is slow and gradual, which imposes the finding that possibly the state of Bahia will not have coverage to all jurisdictional units at the end of the term, in 2022.
