La importancia de la regulación sobre apatridia en el Perú ante la aparición de niños apátridas por la migración venezolana

En la actualidad, la ausencia de regulación normativa en el Perú respecto a la apatridia, constituye una brecha legal que debe ser establecida como tal. La apatridia, siendo la condición de no tener nacionalidad, se ha acentuado en el país, especialmente en el contexto de la migración masiva venezolana impactando a Perú en los últimos años y a otros países de la región. La falta de una regulación específica crea un vacío legal que afecta a aquellos que llegan al país buscando mejores oportunidades, pero que, debido a diversas circunstancias, quedan en un limbo legal sin pertenecer a ningún Estado. Esta situación no solo vulnera sus derechos fundamentales, sino que también dificulta su acceso a servicios básicos y protección legal. En ese sentido, la presente tesis aspira a demostrar que, ante la afluencia masiva de personas venezolanas al territorio peruano, se ha evidenciado la falta de un marco normativo para identificar y proteger a las personas apátridas. Para ello, se abordará el marco conceptual, el marco legal internacional y nacional, así como ciertos casos de jurisprudencia en temas de Nacionalidad y Apatridia. Posteriormente, se describirán los sucesivos movimientos migratorios de venezolanos hacia el Estado peruano, la aparición de niños apátridas en la región, y la regulación de casos de niños apátridas registrados en otros países de la región. Finalmente, se establecerán las conclusiones y recomendaciones frente a este reciente fenómeno, con la finalidad de establecer un marco legal claro y específico que permita al Estado identificar y proteger a aquellos en riesgo de apatridia.Currently, the absence of regulatory regulation in Peru regarding statelessness constitutes a legal gap that must be established as such. Statelessness, being the condition of not having nationality, has increased in the country, especially in the context of massive Venezuelan migration, impacting Peru in recent years and other countries in the region. The lack of specific regulation creates a legal vacuum that affects those who arrive in the country seeking refuge or better opportunities, but who, due to various circumstances, are left in legal limbo without belonging to any State. This situation not only violates their fundamental rights, but also hinders their access to basic services and legal protection. In this regard, the present thesis aims to demonstrate that the massive influx of Venezuelan people into Peruvian territory has revealed the lack of a regulatory framework to identify and protect stateless persons. To this end, the conceptual framework, the international and national legal framework, as well as certain cases of jurisprudence on issues of Nationality and Statelessness, will be addressed. Subsequently, the successive migratory movements of Venezuelans to the Peruvian state, the appearance of stateless children in the region, and the regulation of cases of stateless children registered in other countries of the region will be described. Finally, the conclusions and recommendations regarding this recent phenomenon will be established, with the aim of creating a clear and specific legal framework that allows the state to identify and protect those at risk of statelessness.
