Sovereign Immunity and Public Universities: Influences on Employment Law in Illinois

The overarching conclusion of the study was that, despite expanded federal sovereign immunity protection, the recent USSC's decisions have had little influence on public higher education in the State of Illinois. A more pronounced influence was noted regarding remedies, but state sovereign immunity protections and the recent narrowing of immunity overshadowed the discussion of the impact of USSC decisions. The rationales for increased protection were not realized with regard to state dignity, but protection of the state treasury was an important rationale articulated by all three groups of practicing attorneys. Recommendations for further study conclude the manuscript and provide guidance on continued legal and empirical research in this area.
