This essay analyses the judiciary application of An Act respecting the protection of persons whose mental state presents a danger to themselves or to others. First, it looks at how the notion of danger to oneself or to others, as well as the underlying mental state, are defined, used and interpreted. Both of these notions come from the field of medicine and are essential to the implementation of this Act. Second, this essay verifies whether some elements of procedure, service and delays, are compatible with the respect of fundamental rights and liberties, notwithstanding that they are sometimes hardly applicable or rarely applied.
