Pendapat tokoh agama terhadap utang panenan kopi: Studi kasus di Desa Sidomulyo Kecamatan Silo kabupaten jember

INDONESIA: Ajaran Islam tidak terlepas dari kodrat manusia sebagai makhluk sosial yang tidak dapat hidup sendiri tanpa orang lain. Kegiatan muamalah bagian dari hukum Islam yang mengatur hubungan antar seseorang dengan orang lain, baik antar pribadi maupun berbentuk badan hukum. Meskipun fiqih muamalah diatur dan banyak dibicarakan dalam kitab-kitab fiqih klasik dan kontemporer, akan tetapi tidak semua bentuk transaksi dapat diatur karena fiqih muamalah bersifat dinamis, progresif dan sesuai dengan perkembangan zaman yang setiap waktu terus berubah. Penelitian ini fokus terhadap dua permasalahan yang menjadi kajian pokok, pertama, bagaimana praktek utang panenan kopi yang terjadi di Desa Sidomulyo Kecamatan Silo Kabupaten Jember. Kedua, bagaimana pandangan tokoh agama sterhadap praktek utang panenan kopi di Desa Sidomulyo Kecamatan Silo Kabupaten Jember. Penelitian ini merupakan jenis penelitian empiris dengan menggunakan pendekatan kasus (Case Approach). Sedangkan objek penelitian ini adalah masyarakat Desa Sidomulyo, Kecamatan Silo, Kabupaten Jember. Metode yang digunakan dalam penelitian ini adalah metode penelitian kualitatif dengan hasil pengumpulan data melalui wawancara dan dokumentasi. Informan dalam penelitian ini adalah tokoh agama dan penduduk desa Sidomulyo yang terlibat dalam transaksi utang panenan kopi. Berdasarkan hasil penelitian yang peneliti lakukan, maka dapat dideskripsikan: 1) praktek utang panenan kopi yang terjadi di Desa Sidomulyo adalah praktek utang piutang dengan pembayaran kopi panenan oleh pihak yang berutang kepada pihak yang memberikan pinjaman (piutang), pembayaran dengan kopi tersebut merupakan kebiasaan yang dilakukan oleh masyarakat ketika mereka melakukan praktek utang piutang. Pembayaran dengan kopi basah tersebut disesuaikan dengan jumlah utang yang dipinjam. Besaran potongan atau stand harga tersebut tergantung kesepakatan awal yang dibuat oleh kedua belah pihak. 2) Menurut tokoh agama bahwa praktek utang panenan kopi di desa Sidomulyo kecamatan Silo kabupaten jember adalah boleh karena tidak terjadi pertambahan nilai pada pinjaman uang. Dengan berdasarkan kesepakatan dan keikhlasan dari kedua belah pihak.
