Ochrona prawa do prywatności w polskim procesie karnym, w świetle orzecznictwa Europejskiego Trybunału Praw Człowieka i Trybunału Sprawiedliwości Unii Europejskiej

Abstract

Niniejsza rozprawa poświęcona jest problematyce ochrony prawa do prywatności w polskim procesie karnym, w świetle orzecznictwa dwóch europejskich sądów: Europejskiego Trybunału Praw Człowieka i Trybunału Sprawiedliwości Unii Europejskiej. W pracy badaniu poddano kształt podstawowych instytucji procesu karnego, które pozostają w ścisłym związku ze sferą prywatną jednostek, przez pryzmat standardu europejskiego, zdekodowanego w oparciu o orzecznictwo ETPC i TSUE. Podjęte rozważania dowodzą, że obecny kształt normatywny regulacji karnoprocesowej, w części, nie pozostaje zgodny z europejskimi standardami dopuszczalności ograniczenia analizowanego prawa jednostki. Drugim, ze zidentyfikowanych źródeł naruszeń prawa do prywatności w procesie karnym, jest wadliwa praktyka organów stosujących prawo. Niedoskonałym, choć cennym narzędziem do konwalidowania aktualnego stanu rzeczy, wydaje się być upowszechnienie znajomości orzecznictwa sądów europejskich, zarówno wśród organów tworzących jak i stosujących prawo a przede wszystkim uwzględnianie a nie ignorowanie wskazań z niego płynących. This dissertation addresses the issue of the protection of the right to privacy in Polish criminal process, in the light of the case law of two European courts: the European Court of Human Rights and the Court of Justice of the European Union. The dissertation examines the shape of the fundamental institutions of the criminal process, which are closely related to the private sphere of individuals, through the prism of the European standard, decoded based on the case law of the ECHR and the CJEU. The considerations undertaken prove that the current normative shape of criminal procedural regulation is, partially, not consistent with European standards of admissibility of limiting the analyzed individual right. The second identified source of violations of the right to privacy in criminal proceedings is the faulty practice of law enforcement authorities. An imperfect, although valuable tool for validating the current state of affairs seems to be the dissemination of knowledge of the case law of European courts, both among the bodies creating and applying the law and, above all, the taking into account and not ignoring the indications coming from it.
