Abstract
Zasadniczym problemem badawczym podejmowanym w niniejszej pracy jest ukazanie normatywnego związku pomiędzy ustawowymi znamionami przestępstwa uprowadzenia małoletniego a zasadą dobra dziecka, zaś następnie wszelkich karnoprawnych konsekwencji związanych z tą okolicznością. Wymiar uwzględnienia dobro dziecka w ujęciu ustawowych znamion czynu zabronionego stypizowanego w przepisie art. 211 K.k. Przyjęta struktura pracy ma na celu ukazanie problematyki przestępstwa uprowadzenia małoletniego w kontekście zasady dobra dziecka w sposób jak najbardziej przejrzysty oraz uporządkowany i kompleksowy. The paper explores the correlation between the statutory elements of the crime of child abduction and the best interest of the child doctrine, as well as the relevant criminal consequences. The scale of considering the best interest of the child within the statutory elements of a crime defined in Article 211 of the Criminal Code. The paper is structured so as to present the crime of child abduction in the context of the best interest of the child doctrine clearly and transparently.
