Zagadnienia wykładni prawa w unijnych kontekstach interpretacyjnych. O adekwatności i możliwych rozwinięciach derywacyjnej koncepcji wykładni

Przedmiotem rozprawy są zagadnienia wykładni prawa z elementem unijnym, w kontekście adekwatności zastosowania i rozwoju idei poznańskiej i szczecińskiej szkoły teorii prawa, które znalazły wyraz w zasygnalizowanej przez Z. Ziembińskiego i opracowanej przez M. Zielińskiego derywacyjnej koncepcji wykładni. Szczegółowym celem naukowym dysertacji jest weryfikacja bądź falsyfikacja tezy o adekwatności zastosowania i możliwości dalszego rozwijania koncepcji derywacyjnej do dokonywanej na forum krajowym wykładni prawa uwzględniającej unijny kontekst interpretacji. Biorąc pod uwagę założenia intelektualne leżące u podstaw koncepcji derywacyjnej i postulowane przez nią metody interpretacji tekstów prawnych, w świetle wykazanych własności semiotycznych unijnych tekstów prawnych w pracy ustalono adekwatność instrumentarium koncepcji derywacyjnej do interpretacji prawa w ramach porządku prawnego o otwartej strukturze źródeł prawa. W gąszczu legislacji koncepcja derywacyjna postuluje pewien wspólny mianownik (normę prawną), pozwalający interpretatorowi na jednoznaczne określenie sytuacji normatywnej podmiotów krajowych ze względu na zbiegające się przepisy prawne o odmiennym pochodzeniu instytucjonalnym. The dissertation focuses on the issues of legal interpretation involving an element of the European Union law, in the context of adequacy of the application and development of the ideas represented by the Polish schools of legal theory in Poznan and Szczecin and embodied in the concept of derivative legal interpretation initiated by Z. Ziembinski and further developed by M. Zielinski. The specific objective of the dissertation consists in the verification or falsification of the postulated hypothesis that the concept of derivative legal interpretation may be applied and further developed onto the acts of legal interpretation pro foro interno in the European Union interpretative contexts. Given the intellectual assumptions underlying the concept of derivative legal interpretation and its postulated methods applicable to the interpretation of legal texts, in light of the established semiotic properties of the European Union legal texts it has been determined that the instruments offered by the concept of derivative legal interpretation are adequate for purposes of legal interpretation in the framework of a legal order characterized by the open structure of the sources of law. In the maze of legislative acts, the concept of derivative legal interpretation provides for a common denominator (legal rule) enabling the interpreters to determine, in unambiguous terms, the normative situations of domestic persons in the framework of concurrent legislative acts originating in different institutional backgrounds.
