The text of the law equals a breathing alcohol concentration of 0.25 mg/l with a blood alcohol concentration of 0.5 ‰. Several surveys could not confirm the according conversion factor of 2. In our study the amount of drunken alcohol was measured individually to cause a blood concentration of 0.5 ‰. A conversion factor of 1.65 was found. In the range of achieved blood alcohol concentration up to 0.5 ‰ the conversion factor was found to be 1.58 ‰. In the range of achieved blood alcohol concentration from 0.5 ‰ and higher the conversion factor was found to be 1.87 ‰. The difference is significant. Thus the translation from breath alcohol concentration into blood alcohol concentration by means of a constant conversion factor is not possible. Therefore the postulation is to find a stochastic dependence between a measured breath alcohol concentration and the according accident risk. The translation would then become unnecessary.
